Unless the context otherwise requires, words in the singular shall include the plural and vice versa.
The term “including” does not exclude anything not listed thereafter, and any obligation related to not doing something includes an obligation of not allowing that thing to be done.

All sections in these Terms and Conditions shall survive any termination or expiration of these Terms and Conditions.
Risks Associated with Purchase and Use of World Masonic Coin Solidus
Users expressly acknowledge and understand that World Masonic Coin Solidus, cryptocurrency, blockchain technology, Ether, Ethereum and other related technologies are new and in certain cases untested, and particularly that they are outside of the Association exclusive control.
Users acknowledge and confirm that prior to purchasing and receiving World Masonic Coin Solidus, they have been advised of the following risks, related to World Masonic Coin and blockchain technology in general:
1. Lack of Professional Expertise in Dealing with Cryptographic Assets and Blockchain-based Software Systems

6. Changes to the Project

Representations and Warranties

The User warrants and represents that he/she does not intend to hinder, delay or defraud U.G.M.A. or any other Users of the Website, as well as that the User’ participation in the World Masonic Coin Solidus ICO (PSM) is not connected to engaging in any illegal conduct and/or unlawful activity. U.G.M.A. reserves the right to amend these Terms and Conditions at any time with immediate effect by publishing the updated Terms and Conditions on the Website. All such changes will take effect once they have been posted on the Website and the User will be deemed to have accepted any such changes by the User’s use of the Website from such time.
These Terms and Conditions may be amended from time to time in the following circumstances:

any loss or damage with regard to the User’s data or other data directly or indirectly caused by malfunction of any third party systems, power failures, unlawful access to or theft of data, computer viruses or destructive code on any third party systems or programming defects;
and/or
-
any interruption, malfunction, downtime or other failure of services provided by third parties, including, without limitation, third party systems such as the public switched telecommunication service providers; internet service providers, electricity suppliers, relevant local authorities and certification authorities; or any other event over which U.G.M.A. has no direct control.
Users shall take proper measures to protect their World Masonic Coin Solidus Wallets keys, without which Users will not be able to access their personal wallets and use World Masonic Coin Solidus which they have purchased during the World Masonic Coin ICO (PSM). Force-Majeure

For the purpose of these Terms and Conditions a force-majeure shall include, but not limited to lightning, flood, exceptionally severe weather, fire, explosion, war, civil disorder, industrial disputes, acts or omissions of persons for whom we are not responsible, acts of government or other competent authorities (including telecommunications and internet service providers).
The User indemnifies and holds U.G.M.A. (including its affiliates, contractors and service providers) harmless against all and any losses, liability, actions, suits, proceedings, costs, demands and damages of all and every kind, (including direct, indirect, special or consequential damages), and whether in an action based on contract, negligence or any other action, arising out of or in connection with the failure or delay in the performance of the World Masonic Coin Solidus Project, whether due to U.G.M.A. (including its affiliates, contractors and service providers) negligence or not.
Non — Refundable Purchases
All purchases of World Masonic Coin Solidus are final and, therefore, non-refundable.
By purchasing World Masonic Coin Solidus, the User acknowledges that U.G.M.A. (including its affiliates, directors, employees, agents, contractors and service providers) is not required to provide a refund for any reason, and that the User is not entitled to receive money or any other form of compensation for any World Masonic Coin Solidus that are not used or not suitable for their intended purpose.
Notification of Special Purpose

The User acknowledges that all intellectual property rights over the contents of the Website are vested in U.G.M.A.. Except as expressly and specifically set forth in these Terms and Conditions, no representations, statements, consents, waivers, or other acts or omissions by U.G.M.A. shall be neither considered as an amendment of these Terms and Conditions nor be legally binding.
Severability
If any term, covenant, condition, or provision of these Terms and Conditions shall be invalid, illegal or unenforceable in any jurisdiction shall, as to such jurisdiction be ineffective to the extent of such invalidity, illegality or unenforceability without affecting the validity, legality and enforceability of the remaining terms and conditions; and the invalidity of a particular provision in a particular jurisdiction shall not invalidate such provision in any other jurisdiction.
Both the User and U.G.M.A. agree that if any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, such provision shall be severed and the remainder of the provisions of these Terms and Conditions shall continue in full force and effect as if the provision in question had been deleted.
Limitation of Liability and Indemnity
Subject to any Applicable Laws and Regulations, the User agrees that U.G.M.A. shall not be liable for any costs, claims, damages (including, without limitation, indirect, extrinsic, special, penal, punitive, exemplary or consequential losses (such as loss of profits, business, goodwill, revenue or anticipated savings) or damage of any kind), penalties, actions, judgments, suits, expenses, disbursements, fines or other amounts that you or any third party might suffer that relate to or arise from these Terms and Conditions or purchase and use of World Masonic Coin Solidus, or termination of these Terms and Conditions, for any reason, whether or not anyone anticipated or should have anticipated that the damages would occur.
Subject to any Applicable Laws and Regulations, the User shall not have any claim of any nature whatsoever against U.G.M.A. for any failure by U.G.M.A. to meet any of U.G.M.A. obligations under these Terms and Conditions as a result of causes beyond U.G.M.A. control.

Any party related to the ICO (PSM) of World Masonic Coin Solidus shall not be liable for any losses howsoever caused as a result of, arising from, or in connection with, whether directly or indirectly, the following:
